4. Course Enrollment and Access

4.1 Course Availability

We strive to maintain continuous access to all enrolled courses, but we do not guarantee that any particular course will be available indefinitely. Courses may be modified, updated, or discontinued at our discretion.

4.2 Enrollment Terms

When you enroll in a masterclass, you receive access to the course materials according to the terms specified at the time of purchase. Access periods, if applicable, begin from the date of enrollment unless otherwise stated.

4.3 Course Content

All course content, including videos, demonstrations, written materials, assignments, and supplementary resources, is provided for educational purposes only. Course content may be updated or modified without prior notice to reflect current best practices and techniques.

5. Payment and Refunds

5.1 Pricing

All prices displayed on the Platform are in the currency indicated at checkout. We reserve the right to modify pricing at any time, though changes will not affect courses already purchased.

5.2 Payment Processing

By providing payment information, you represent and warrant that you are authorized to use the designated payment method and authorize us to charge all fees incurred.

5.3 Refund Policy

Refund eligibility is determined according to our refund policy communicated at the time of purchase. Unless otherwise specified, refund requests must be submitted within the designated period from the date of purchase. Refunds are processed to the original payment method and may take several business days to appear.

5.4 Subscription Services

If you purchase a subscription, your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. You are responsible for all charges incurred until cancellation takes effect.

6. Intellectual Property Rights

6.1 Platform Ownership

The Platform and all content, features, and functionality, including but not limited to text, graphics, logos, videos, demonstrations, images, audio, software, and course materials, are owned by Novarixelo, our licensors, or content providers and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 User Content License

If you submit, post, or upload any content to the Platform, including comments, reviews, questions, or assignments, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with operating and promoting the Platform.

6.3 Prohibited Uses of Content

You may not download, record, reproduce, distribute, modify, display, perform, publish, license, or create derivative works from any course content except as explicitly permitted for personal educational use within the Platform interface.

7. User Conduct and Prohibited Activities

7.1 Community Standards

You agree to interact respectfully with instructors and other users. Harassment, abuse, discrimination, threats, or inappropriate behavior will not be tolerated.

7.2 Prohibited Content

You may not post or transmit content that:

Is illegal, harmful, threatening, abusive, defamatory, or obscene
Violates any intellectual property or proprietary rights
Contains viruses, malware, or other harmful code
Impersonates any person or entity or misrepresents your affiliation
Contains unsolicited advertising, promotional materials, or spam
Violates the privacy or publicity rights of others

8. Instructor Content and Third-Party Services

8.1 Instructor Independence

Instructors featured on the Platform are independent professionals. Their views, opinions, and techniques are their own and do not necessarily reflect those of Novarixelo. We do not endorse or guarantee the accuracy, reliability, or quality of instructor content.

8.2 Third-Party Links

The Platform may contain links to third-party websites or resources. We provide these links for convenience only and are not responsible for the content, products, or services offered by third parties.

9. Privacy and Data Protection

Your use of the Platform is subject to our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Platform, you consent to our data practices as described in the Privacy Policy.

10. Disclaimers and Limitations of Liability

10.1 Service Availability

To the maximum extent permitted by law, Novarixelo and its officers, directors, employees, instructors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the Platform, even if advised of the possibility of such damages.

10.5 Maximum Liability

Our total liability for any claims arising from or related to these Terms of Use or your use of the Platform shall not exceed the amount you paid to us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless Novarixelo and its officers, directors, employees, instructors, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses, including reasonable legal fees, arising out of or related to:

Any content you submit, post, or transmit through the Platform

12. Termination

12.1 Termination by You

You may terminate your account at any time by contacting us at help@novarixelo.com. Termination does not entitle you to a refund of any fees already paid.

12.2 Termination by Us

We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without notice, for any reason, including if we believe you have violated these Terms of Use or engaged in fraudulent or illegal activity.

12.3 Effect of Termination

Upon termination, your right to access and use the Platform immediately ceases. Provisions of these Terms of Use that by their nature should survive termination shall continue to apply, including ownership provisions, warranty disclaimers, indemnification, and limitations of liability.

13. Modifications to Terms and Platform

13.1 Changes to Terms

14. Dispute Resolution

14.2 Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to these Terms of Use or your use of the Platform that cannot be resolved informally shall be settled by binding arbitration in accordance with the rules of a recognized arbitration organization.

14.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

15. General Provisions

15.1 Entire Agreement

These Terms of Use, together with our Privacy Policy and any additional terms communicated to you, constitute the entire agreement between you and Novarixelo regarding the Platform and supersede all prior agreements and understandings.

15.2 Severability

If any provision of these Terms of Use is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

15.3 Waiver

Our failure to enforce any right or provision of these Terms of Use shall not constitute a waiver of that right or provision.

15.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of nature, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

16. Additional Terms for Specific Services

16.1 Certificate Programs

If you enroll in a masterclass offering a certificate of completion, you must fulfill all specified requirements, including completing all course modules, assignments, and assessments, to receive the certificate. Certificates are issued electronically and represent completion of the course content, not professional certification or accreditation.

16.2 Live Sessions

Some masterclasses may include live interactive sessions with instructors. Attendance at live sessions is subject to availability and scheduling. Recordings of live sessions, if provided, are for enrolled participants only and may not be shared or distributed.

16.3 Community Features

The Platform may offer discussion forums, comment sections, or other community features. Participation in these features is voluntary and subject to our community guidelines and moderation policies. We reserve the right to remove content or restrict participation at our discretion.
